Terms of Service

Welcome to Speaq! By accessing or using our website located at speaq.in and our messaging services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

1. Eligibility

You must be at least 18 years of age to use this Service. The Service is not intended for, and may not be used by, anyone under 18.

2. User Conduct & Content Guidelines

Speaq is a place for authentic, anonymous human connection. To keep the community safe, you agree not to use the Service to:

🚫 Prohibited Activities:

  • Harass, abuse, threaten, stalk, or bully other users.
  • Transmit hate speech, discriminatory, sexually explicit, or obscene material.
  • Record calls, screenshots, or save chat transcripts without the explicit prior consent of the other user.
  • Impersonate any person or entity or misrepresent your identity.
  • Transmit spam, malware, viruses, or run automated scripts/bots on the matchmaking queue.

We reserve the right to block, ban, or terminate access for any user violating these rules, without warning or liability, at our sole discretion.

3. Ephemeral & Peer-to-Peer Nature

You understand and agree that:

  • Live voice conversations are peer-to-peer (P2P) and fully ephemeral. We do not store, record, or back up call audio or live stranger-chat contents.
  • Speaq AI content may be retained for up to 24 hours to maintain context and restore a recent conversation.
  • Compact memories are retained only after you approve them and can be edited or deleted from your Speaq controls.
  • Once you click "Skip" or close your browser, the conversation is gone forever and cannot be recovered.
  • You are responsible for your own safety. Do not share personal identifiers (real name, phone number, address, social media links) with strangers unless you explicitly choose to do so at your own risk.

4. AI Replies, Membership & Billing

  • Free Replies: Speaq may provide a limited number of free Speaq AI replies. Email verification can be required to unlock part of that allowance.
  • Credit Packs: Paid packs contain the number of successful AI replies shown at checkout. Credits do not expire, may stack, and are consumed only after a reply is successfully generated.
  • Speaq Plus: Speaq Plus is a recurring monthly membership processed by Razorpay. It includes the displayed monthly reply allowance, approved-memory limit, and continuity features. Unused monthly replies expire at the end of each billing cycle and do not roll over.
  • Renewal and Cancellation: Speaq Plus renews automatically until cancelled. Cancellation takes effect at the end of the current paid cycle unless Razorpay or applicable law requires otherwise. Permanent reply-pack credits remain available.
  • Payments: The applicable tax and final total are displayed before payment or mandate authorization. Recurring payment methods may include cards, UPI Autopay, or eMandate where Razorpay enables them.
  • Refunds: Duplicate or erroneous payments may be reviewed using the purchase support reference. A processed refund removes the unused credits from that purchase; replies already consumed cannot be restored or refunded except where required by law.

5. Wellbeing and Safety

Speaq is a conversation product, not a therapist, medical provider, crisis service, or substitute for professional care or human relationships. If Speaq detects language suggesting possible danger, it may ask about immediate safety and display emergency or mental-health resources. In India, emergency assistance is available at 112 and Tele-MANAS at 14416.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT PEER-TO-PEER CONNECTIONS WILL ALWAYS BE STABLE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPEAQ AND ITS DIRECTORS, EMPLOYEES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, EMOTIONAL DISTRESS, OR CONDUCT OF OTHER USERS, ARISING OUT OF YOUR USE OF THE SERVICE.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any legal actions or disputes arising under these Terms shall be resolved exclusively in the competent courts of New Delhi, India.

9. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will post the updated terms on this page. Your continued use of the Service after changes are posted constitutes acceptance of the new Terms.
